1. Eligibility: HEARTH & HOME TECHNOLOGIES® Pellet Challenge Promotion (the “Promotion”) is open only to legal residents of the fifty (50) United States, Canada and the District of Columbia who are at least eighteen (18) years old.

Hearth & Home Technologies, and their respective parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and same household members of each such employee are not eligible. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning prize(s) is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Promotion begins on January 6th, 2012 at 12:00 a.m. (midnight) Central Time ("CT") and ends on March, 31st, 2012 at 11:59 p.m. CT (the "Promotion Period").

4. How to Enter: During the Promotion Period, visit www.harmanstoves.com/pelletchallenge OR www.fireplaces.com/pelletchallenge OR www.quadrafire.com/pelletchallenge and follow the links and instructions to complete and submit the registration form, including a valid home address (P.O. Boxes are not permitted). Receipt of entry will be acknowledged but such acknowledgment does not constitute any representation by Sponsor/Administrator as to Promotion eligibility. For entry to be eligible, photo and/or statement included therein must (a) be the original work of the participant and not copied from elsewhere; (b) not violate the trademark, copyright or other rights of any third party; (c) not be inappropriate or unfit for publication; and (d) meet all technological specifications, including file size and/or format. By submitting an entry, you grant a worldwide, nonexclusive, royalty-free, transferable and sublicensable license to Sponsor and Administrator to use the photo and/or statement (in either original or altered/edited/modified form) in any and all media for any and all purposes for a period of five (5) years without notice or approval to you. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant will be disqualified. Use of any automated system or Promotion service or the like to participate is prohibited and will result in disqualification. Entry information must be manually key-stroked. In the event of a dispute as to any entry, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner(s) may be required to show proof of being the authorized account holder.

5. Prize Drawing: Hearth & Home Technologies, the Administrator, will randomly select the potential Grand Prize winners (two) from all eligible entries received during the Promotion Period, on or around April, 10th 2012. The potential winner(s) will be notified by email, mail or phone. Potential winner(s) may be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize(s). If potential winner(s) cannot be contacted, or fail to submit the Declaration of Compliance within the required time period, or prize(s) is returned as undeliverable, potential winner forfeits prize(s) without compensation of any kind. Potential winner(s) must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Prizes will be fulfilled approximately 10-15 weeks after the conclusion of the Promotion.

6. Prizes/Odds of winning: TWO (2) GRAND PRIZES: The Grand Prize winner will receive a pellet stove OR insert. Odds of winning Grand Prize depend on the number of eligible entries received for the random drawing. No prize transfer. No prize substitution except at Sponsor’s sole discretion for prize(s) of equal value. All expenses related to acceptance or use of prize(s) which are not specified in these Official Rules as well as all applicable taxes on prize(s) are winner’s sole responsibility. Grand Prize winner will be issued an IRS 1099 Tax Form for the value of prize(s) won for the year in which the prize(s) was/were awarded to him/her.

7. Release: By receipt of prize(s), winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of prize(s). Sponsor and Administrator make no representation, warranty or guarantee regarding any prize, directly or indirectly, in fact or in law, including the warranty of merchantability for intended purpose.

8. Publicity: Except where prohibited by law, participation in the Promotion and acceptance of prize(s) constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions, hometown/state and/or other indicia of persona for promotional/trade purposes in any media, worldwide, without further payment or consideration.

9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor will select potential winner(s) and make prizes available in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of the same will be posted at www.harmanstoves.com/pelletchallenge OR www.fireplaces.com/pelletchallenge OR www.quadrafire.com/pelletchallenge. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with (or attempting to tamper with) the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries (including corrupted/disrupted electronic transmissions); (5) late, lost, undeliverable, incomplete, illegible/garbled, damaged, corrupted or stolen entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion; however, if Sponsor determines in its sole discretion that it is not feasible or practicable to do so, Released Parties shall have no liability to such entrant whatsoever. No more than the stated number of prizes will be awarded.

11. Disputes: To the fullest extent permitted by law, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Minnesota (at Minneapolis) or the appropriate Minnesota State Court located in Hennepin County, Minnesota; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
